APPLICANT INTERFACE ADDED TO INSTASCREEN PREMIERE™ 2.0 AS QUICKAPP™ 2
SALT LAKE CITY — (June 30, 2009) —
Streamlining workflow and compliance has always been at the forefront of the TazWorks platform. In 2006, the applicant interface feature was developed allowing end-user clients to avoid the issues involved with collecting personal identifiers (including DOB).
Today, TazWorks announced the release of the Applicant Interface for InstaScreen Premiere 2.0. The new version of the Applicant Interface will be dubbed QuickApp™ 2. With QuickApp™ 2, applicants will complete an online application by entering personal identifiers and other relevant information, such as references and work history. The application is then submitted as ready for processing in InstaScreen. The online application is customizable and includes a disclosure, authorization, digital signature, and input of the applicant identifiers over a secure, SSL encrypted Internet connection.
Industry concern surrounding the Federal Age Discrimination in Employment Act, as well as various state civil rights laws, has caused concern for companies when requesting age or date of birth, as this tends to deter older applicants from applying. Many states have rules that prohibit an employer, either directly or through an agent, from seeking or receiving information that reveals date of birth and age before an offer is made.
Not collecting an applicant’s DOB, however, also presents unique issues. When researching court records, the date of birth is probably the most important identifier needed, since many court records do not contain Social Security Numbers. In some jurisdictions, a criminal search cannot be conducted without a date of birth, while in many states, a date of birth is the key piece of identifying data on motor vehicle records.
Although it is a common misinterpretation, neither the ADEA (Age Discrimination Employment Act) nor the Federal Age Discrimination Act of 1967 prohibits asking for date of birth or age. However, an EEOC ruling indicates that such requests would be closely scrutinized to ensure a legitimate permissible purpose. The EEOC also indicated that the reason for asking for date of birth should be clearly disclosed so that older applicants are not deterred from applying.
